Filling out and signing the entry form for any of the tournaments in the California Billfish Series, together with payment of appropriate entry fee(s), upon acceptance and approval, and subject to all the provisions and terms contained herein and in the tournament rules and material provided, shall entitle the entrant to compete in the California Billfish Series. By accepting a team number, and in exchange for the opportunity to participate in any of the tournaments in the California Billfish Series, the participant agrees to be bound by and adhere to all Tournament rules and regulations, as published or amended, and will personally and on behalf of his or her heirs, successors, servants, assigns, executors, administrators, guardians and conservators hereby release, discharge, cancel, waive, covenant not to sue, acquit, hold harmless the Catalina Classic Marlin Tournament, BDOutdoors.com, Bloodydecks, LLC., Los Angeles County, Catalina Classic sponsors, directors, representatives, attorneys and assigns (collectively the “Classic”),and agree to hold them free and harmless for, from, against any and all claims, judgments, appeals, rights, demands, costs, expenses, liabilities, obligations, claims, actions and causes of actions of any character whatsoever, whether known or unknown, suspected or unsuspected, arising from civil negligence or otherwise, including but not limited to liabilities for personal injury, property damage, or wrongful death caused by such negligence (the “Claims”).
Any misrepresentation on this entry form, signed weighmaster certificates or violation of any Tournament rule will be cause for disqualification and forfeiture of any prize money and or merchandise won in the tournament. The Tournament reserves the right to pursue such misrepresentations without regard to time limits. Team captains must certify that the team’s (vessel) boat conforms to all U.S. Coast Guard regulations and all Coast Guard required equipment is certified current and on board. Participant agrees to accept as binding any and all decisions made by the rules committee of the “Classic”. The “Classic” reserves the right to deny any entry form or reject any entry form once accepted and approved for any reason which in its sole judgment and discretion it deems proper. The “Classic” reserves the right to cancel the tournament for any reason. In the event of any such cancellation, all entrants will be notified immediately and all monies paid by entrants shall be returned and neither party shall have liability to the other. It is expressly understood that all participants enter at their own risk. Each participant must sign a release, showing that he or she has read and understands that they are fully aware of the potential dangers incidental to engaging in such activity and understand the legal consequences of signing this release. As further consideration of being permitted to enter the tournament, the participants hereby irrevocably authorize you, your licensees, successors or assigns to print, publish, televise, video tape or otherwise use my photograph, video tapes or any likeness of me which may be recorded, transmitted, published or otherwise used on television, in print, or any other media during and after said tournament. By entering the “Classic”, you have read and agree to all regulations, regardless of whether you have signed a release. At the sole discretion of the “Classic”, all entrants and their team members (if applicable) may be required to take a polygraph test administered by the tournament’s independent polygraph contractor. All team members must agree to take such polygraph test, if asked, and abide by the results thereof. As an angler and/or team captain, you must sign a release stating that you have read, understood, accept and agree to the foregoing provisions and have read and understand all tournament rules and regulations.
